to Nullify Unlawful Detention of CitizensYesterday, on the same day that we celebrated the signing of the one-gun-a-month repeal, the Virginia Senate also restored the stronger provisions in HB 1160. Thanks to you, this bill passed overwhelmingly -- a mere 24 hours after the Virginia Senate came within a vote of killing this bill for the year.What a difference a day makes … and thousands of emails!HB 1160 will protect Virginia citizens against federal abuse under the National Defense Authorization Act, which was signed into law by President Barack Obama late last year.As we have stated before, if you were to UNKNOWINGLY SELL A GUN to someone like Oklahoma City bomber Timothy McVeigh, then under the provisions of the NDAA you could be indefinitely held by the federal government (without trial), tried in a military court and extradited to a foreign country (where you could be tortured).But the Virginia bill would prohibit any state employee from assisting the federal government in implementing this outrageous law.One day earlier, the Senate had almost killed the bill for the year. In a 20-20 vote, Lt. Gov. Bill Bolling casting the deciding vote to keep the bill alive.Delegate Bob Marshall (R-Manassas) is the author of HB 1160, and he thanked Gun Owners of America for its help in pushing his bill across the finish line."Twenty-four hours after the Virginia State Senate nearly killed my bill, thousands of Virginians learned that our liberties were on the line, and they made their views known," Del. Marshall said. "Groups from the Virginia American Civil Liberties Union to Gun Owners of America … all publicly endorsed HB 1160."GOA activists will be gratified to know that they WERE THE ONLY ONES demanding that the Senate restore the original (stronger) language. In fact, many Senators didn't even know there was a stronger version until they started getting your emails.While the House of Delegates had passed HB 1160, they had limited the scope of Virginia's interposition to the U.S. military, thus exempting nefarious actions perpetrated by the U.S. Marshals, U.S. Attorneys, the FBI, or the ATF.The Senate-passed version, however, restored the original language -- thanks in large part to your calls and emails.ACTION: Please contact your Delegate IMMEDIATELY and urge them to support the Senate-passed version of HB 1160. Most of the Delegates have already voted in favor of this legislation once, but they need to understand the pro-gun vote is to support the Senate version.Not sure who your delegate is? [Name]"* Compose and send messageDear Delegate:Please support House Bill 1160. But in doing so, please insure that you support the Senate-passed version of House Bill 1160, rather than the version passed by the House.The version passed by the Virginia Senate states that no state employee "shall aid an agency of the United States in the unlawful detention of any United States citizen." Note the pivotal words "an agency of."That provision will prevent the state of Virginia from helping ANY agency of the federal government to arrest and detain Virginia citizens under the provisions of the NDAA.But the version passed by the House would ONLY prohibit aid to "an agency of the armed forces of the United States." Hence, the House version would not seem to apply to nefarious actions perpetrated by U.S. Marshals, U.S. Attorneys, the FBI, or the ATF.The problem is this: Even in the case of a military trial, the guy knocking on my door at 3:00 a.m. is probably not going to be the armed forces. He is, more likely, going to be a U.S. Marshal. And, thus, the bill as passed in the House will not help me.Please support the Senate version of HB 1160.Sincerely,
