Virginia Senate Passes Strong Bill
to Nullify Unlawful Detention of Citizens
 
Yesterday, on the same day that we celebrated the signing of the one-gun-a-month repeal, the Virginia Senate also restored the stronger provisions in HB 1160. Thanks to you, this bill passed overwhelmingly -- a mere 24 hours after the Virginia Senate came within a vote of killing this bill for the year.
 
What a difference a day makes … and thousands of emails!
 
HB 1160 will protect Virginia citizens against federal abuse under the National Defense Authorization Act, which was signed into law by President Barack Obama late last year.
 
As we have stated before, if you were to UNKNOWINGLY SELL A GUN to someone like Oklahoma City bomber Timothy McVeigh, then under the provisions of the NDAA you could be indefinitely held by the federal government (without trial), tried in a military court and extradited to a foreign country (where you could be tortured).
 
But the Virginia bill would prohibit any state employee from assisting the federal government in implementing this outrageous law.
 
One day earlier, the Senate had almost killed the bill for the year. In a 20-20 vote, Lt. Gov. Bill Bolling casting the deciding vote to keep the bill alive.
 
Delegate Bob Marshall (R-Manassas) is the author of HB 1160, and he thanked Gun Owners of America for its help in pushing his bill across the finish line.
 
"Twenty-four hours after the Virginia State Senate nearly killed my bill, thousands of Virginians learned that our liberties were on the line, and they made their views known," Del. Marshall said. "Groups from the Virginia American Civil Liberties Union to Gun Owners of America … all publicly endorsed HB 1160."
 
GOA activists will be gratified to know that they WERE THE ONLY ONES demanding that the Senate restore the original (stronger) language. In fact, many Senators didn't even know there was a stronger version until they started getting your emails.
 
While the House of Delegates had passed HB 1160, they had limited the scope of Virginia's interposition to the U.S. military, thus exempting nefarious actions perpetrated by the U.S. Marshals, U.S. Attorneys, the FBI, or the ATF.
 
The Senate-passed version, however, restored the original language -- thanks in large part to your calls and emails.
 
ACTION: Please contact your Delegate IMMEDIATELY and urge them to support the Senate-passed version of HB 1160. Most of the Delegates have already voted in favor of this legislation once, but they need to understand the pro-gun vote is to support the Senate version.

Dear Delegate:
 
Please support House Bill 1160. But in doing so, please insure that you support the Senate-passed version of House Bill 1160, rather than the version passed by the House.
 
The version passed by the Virginia Senate states that no state employee "shall aid an agency of the United States in the unlawful detention of any United States citizen." Note the pivotal words "an agency of."
 
That provision will prevent the state of Virginia from helping ANY agency of the federal government to arrest and detain Virginia citizens under the provisions of the NDAA.
 
But the version passed by the House would ONLY prohibit aid to "an agency of the armed forces of the United States." Hence, the House version would not seem to apply to nefarious actions perpetrated by U.S. Marshals, U.S. Attorneys, the FBI, or the ATF.
 
The problem is this: Even in the case of a military trial, the guy knocking on my door at 3:00 a.m. is probably not going to be the armed forces. He is, more likely, going to be a U.S. Marshal. And, thus, the bill as passed in the House will not help me.
 
Please support the Senate version of HB 1160.

[Peninsula-Patriots] Request for help

Delegate Bob Marshall has asked me to help him get signatures on a petition to have his name on the Ballard for US Senate in November 2012. His wife Cathy gave me the petitions at Mike Punty's meet and greet for Bob last month. I need to get them in the hands of those in Mathews willing to help Bob get the 10,000 signatures required.He told me that one effective way of obtaining signatures is at the Republican primary next month because people at the primary are registered voters. I plan to work the Westville precinct and could use some help there and need people at the other two precincts also. If you can help please let me know and I will bring petitions to you. If you live in Gloucester I will bring them to you also.  As you know Del. Marshall has done more for Virginia and it's citizens since he has been in office than anyone I know. He sponsored the Virginia Health Care Freedom Act to protect us from Obama Care and now has sponsored HB 1160 which protects us from seizure and detention without trial by the federal government (see article below). We have outstanding Republican candidates for senate and surely Del. Marshall is among them. Your help would be greatly appreciated.

Important information on 3 Bills!  HB 430; HB 1160, & SB 274!

KILL  HB 430

 

HB 430 Will expand the "Regional Cooperation Incentive Fund", and allow the fund to offer an increased amount of government grant money to planning commissions that "consolidate or coordinate" with other local planners.  Or in other words, regionalize.

You may be wondering, what's wrong with that?

 

Regionalization.  If you don't know what it is, you will soon.  It's an interim step on the road to globalization.  It's another layer of government, unelected, unaccountable.  Municipalities are formed into border-less groups, and allowed to development comprehensive plans and land use goals that supersede their local laws and often disregard property rights---then they'll go back to the local community and say that they are required to bring their laws and zoning into line.  That's what is wrong with regionalization.  And, we all know what happens when there's government money attached to something.....

So please tell legislators not to use state tax money to implement regional comprehensive plans, planning should be left up to localities and their elected officials! This bill is on the docket for the, Senate Committee on Local Government-- Tues. Feb 28th, in the afternoon.

Tenth Amendment CenterHB 1160!

Today, the Virginia State Senate held a procedural vote on House Bill 1160 (HB1160), commonly referred to as the “Virginia NDAA Nullification Bill.” There was a “motion to recommit” the bill – essentially delaying a vote on it until next year. The bill was almost put on hold as the vote in the Senate was 20-20. The Lt. Governor, though, decided that this was an issue worth voting on now, not next year, and was the deciding vote that stopped the motion.

That means HB1160 will almost certainly come up for a vote in the Virginia Senate tomorrow, Tuesday, TODAY, February 28, 2012.

If you live in Virginia (or know someone who does), the time to act in support of liberty is right now. Not next week. Today, not tomorrow. Now. (action steps below)

The legislative goal of HB1160 is to codify in Virginia law noncompliance with what many are referring to as the “kidnapping provisions” of section 1021 and 1022 of the National Defense Authorization Act of 2012 (NDAA).

The official summary of 1160:

“A BILL to prevent any agency, political subdivision, employee, or member of the military of Virginia from assisting an agency of the armed forces of the United States in the investigation, prosecution, or detention of a citizen in violation of the United States Constitution, the Constitution of Virginia, or any Virginia law or regulation.”

HB1160 is sponsored by Delegate Bob Marshall, who recently told The New American – “They say this law [the NDAA] is designed to fight terrorists. You don’t defeat terrorists by adopting their tactics. I will be faithful to my calling to stand against these predators who would sell their birthright for a mess of pottage.”

Marshall previously reported that Governor Bob McDonnell is opposing this legislation. Residents all over Virginia are strongly encouraged to contact their Senators AND the Governor’s office in support of this legislation now.

 (SB274):  

Thank you to everyone who worked so hard to make UDAs optional.   SB274 UDAs optional has passed both houses! Urban Development Areas are a Trojan horse that will usher in United Nations led control over local communities through federal grants and programs.  One may assume just adopting a UDA on paper will do no harm, but adopting the plan opens the door to the whole agenda of sustainable development. 
Once established, developers will push to develop the 
UDAs because of income tax breaks and available federal grants through HUD & the Dept. of Energy.These grants come with strings attached, as you might imagine, that will forever change the county.  Buildings, materials, roads, drainage, plumbing and regulations must adhere to strict environmental standards and eventually, emphasis will be placed on changing ordinances for the remainder of the county to be consistent with sustainable goals.

Rumors are widely circulated now that you are against protecting Virginia citizens against unlawful and unconstitutional arrest and detention under the National Defense Authorization Act (N.D.A.A.). Let us all hope this is not true!
 
Rumors also abound in your intense interest in being selected as a Vice Presidential candidate.
 
If both of these rumors are indeed true, then they are in direct conflict, as the reaction by Virginia grassroots conservative activists across the entire state to your betrayal of them on the first will be an open campaign of equal or greater intensity against you having any success at the second.
 
I would surely join them.
 
You took an oath to uphold and defend the Constitutions of both Virginia and the United States, Mr. Governor.
